Statute: 135 Stat. 259
Became law: Apr 23, 2021
Summary
Allows Senate employees to work for more than one office at the same time, such as for two different Senators or a Senator and a committee.
What problem does this solve?
Before, Senate offices could not easily share staff, which made it hard to use resources well. This law creates a system for employees to work for multiple offices, making it easier to share skills and costs.
What does this law do?
Allows sharing of Senate employees
Permits a single employee to work in more than one Senate office, such as for a Senator, a committee, or a leadership office, in a designated 'qualifying position'.
Sets a cap on total pay
Ensures that the total pay a shared employee receives from all their positions does not go above the existing maximum pay rate for Senate staff.
Clarifies rules for travel and equipment
States that the office authorizing travel must pay for it. Allows shared employees to use a single handheld device, like a phone, for all their official email accounts.
Defines pay for ethics reporting
For financial disclosure reports required by ethics laws, a shared employee's pay is considered the total amount they receive from all their Senate jobs combined.
Restricts sharing for certain offices
Employees of the Secretary of the Senate or the Sergeant at Arms can only be shared between those two offices, unless the Committee on Rules and Administration approves another arrangement.
Requires IT staff to follow security rules
If a shared employee provides IT services, they must follow all technology and security rules set by the Sergeant at Arms.
Who does this affect?
- Senate employees
- Senators
- Senate committees and offices
What is the real world impact?
•
Improves office efficiency
Allows Senate offices to share staff with special skills or to fill part-time needs. This helps offices use their money and people more effectively, especially smaller offices that can't afford a full-time expert.
When does this start?
The rules for sharing employees begin 6 months after the law was signed on April 23, 2021.
